I was planning on doing a video surrounding the acquittance of the Jian Ghomeshi trials, but it was just way too hard to do all in one take. So much information to throw around, so much testimonies to speak upon. I did about a dozen takes before I said; "Fuck it. Typing it out is gonna be better for me".
Long story short, Ghomeshi was charged with four charges of sexual assault and one count of resistance via choking. They had an
eight day trial in Early February, where three women testified against Ghomeshi, and on Thursday, Ghomeshi was acquitted of all charges due to insufficient evidence against him.
My social media outlets went fucking nuts about this, basically saying that Ghomeshi got away with murder, but I needed to figure out what was said in the trial before I pass jugement on it. What I found out during the trials took me by surprise.
The three women that testified all had similar stories - they met Ghomeshi, both were flirting, and were making out with each other. Ghomeshi did some pretty aggressive shit to them, but not to the point of rape. None of the women were raped.
This is where, in my honest to god opinion, that Judge William Horkins did a Grade-A job of.
The first witness said she never spoke with Ghomeshi again after the incident. An email in 2004 wishing him well and an attached picture of her in a bikini proved her wrong.
The second witness said that she stayed polite to him, but never wanted to continue the relationship. Multiple e-mails of her wanting the relationship to continue, and a love letter further proved that wrong. Hell, the day after the alleged incident, she said "You kicked my ass last night and that makes me want to fuck your brains out tonight".
The third witness said that she got bit in the shoulder and choked her at a park. However, what she didn't reveal until later is that after it happened, she gave Ghomeshi a handjob. Then, on her phone, it revealed that the second and third witness were in collusion.
For someone to be guilty, they have to have a sufficient amount of evidence that leaves no doubt in the case. With all three testimonies having so many holes to them, Horkins had no choice but to acquit Ghomeshi.
I can already hear people accusing me of defending Ghomeshi here. I'll tell you right now that I don't condone anything that Ghomeshi has done to the women accusing him. He's still a scumbag, and he's not completely out of the water yet. Another trial in June will see him being testified again.
However, further ruining a man's career by being in collusion with another and leaving out key information of their incidents is just as bad. Sure, their memory can be spotty after 12+ years, but key information such as e-mails wanting to 'fuck your brains out' and a public handjob isn't something you want to hide from a judge in a supreme court.
There's my two cents. Take it for what it's worth - discuss further on it, criticize my analysis on it, do whatever you want. I'm just tired of people pointing the finger at Horkins and saying 'THIS is rape culture'. I mean, this is what a judge is fucking supposed to do when there's reasonable doubt in the trial.
Longer story short; Ghomeshi is a scumbag for being aggressive and violent to these women, but the three witnesses are also scumbags for not disclosing crucial information and colluding together to further ruin a man's livelihood.
